The space shuttle Discovery went up, it came down, it’s safe and sound. Going ’round the earth in circles seems kind of pointless to me, though. I’d much rather we work on a way to zip on over to 55 Cancri f, where a fifth planet has been found around the very sun-like star. It’s in the habitable zone, but about Neptune sized so it’s probably not much like Earth. It’s probably perfect for the Transgendered Purple Octopus Aliens, though. Y’all thought I was kidding about them, didn’t ya’?

The Flyboys are much improved over last year. They’re gonna kick some butt this year. Uncle Kev the sports machine is picking them for the cup. The Eagles, not so much. The Phils dudded. Other than the dreamboats on ice, it’s sucking to be a Philadephia sports fan these days. (I don’t follow basketball, and I despise the Eagles, but I feel for Uncle Kev. He had such high hopes for the birds this year.)

Matt flings some poo at this new classic from perennial nutjob MinTheGap, who tells us that if there is such a thing as Global Warming, it’s just God using the weather to draw our attention to our sin. That guy’s so far out there, he’s half-way to 55 Cancri.

Lori Chalupny Busts Her Cherry

The U.S. is currently dead even with North Korea in our group. They need to win, and win more decisively than North Korea to advance to play England. Should we not do as well as North Korea (currently losing tied with Sweden on ESPN2), we advance to play Germany.

Just so y’know.

(P.S. ESPN is pissin’ me off. They keep putting up graphics that are covering large portions of the screen. I appreciate the info, but they need to keep it small. I want to watch the game, not the graphics!)

Mike Nifong Gets Gentle Slap On The Wrist

Trust No-one, by BanksyIn the state of North Carolina, repeatedly lying to several courts attempting to inflame racial tension, deceive the public as well as the courts, and convict people you know to be innocent in a effort to gain reelection and secure your pension comes with a serious price:

one day in jail.

Via CNN:

(CNN) — Embattled former district attorney Mike Nifong was held in criminal contempt of court and sentenced to one day in jail Friday for his actions in the flawed Duke lacrosse team rape case.

Nifong must report to jail September 7, Superior Court Judge W. Osmond Smith III said.

The judge said Nifong’s withholding of DNA evidence from defense attorneys was an affront to the integrity of the judicial system.

Supremes Want A Little Alabama Vibrator Action

Bug Girl at Skepchick heard that the Supreme Court of the United States may hear a case involving the ridiculous Alabama law banning the sale of vibrators, discussed a while back at SitPS on WordPress.

“The United States Supreme Court will review a Valley business owner’s case September 24. The issue: selling sex toys. A decision will come by October 1 whether the case will move forward or if the ban stands in Alabama.”

According to a federal court decision announced yesterday (Valentine’s Day!), it’s perfectly fine for the state of Alabama to criminalize the sale of sex toys. Just to put this in context — 41 years after the Supreme Court decided it was unconstitutional to restrict the sale of condoms, the Court of Appeals for the 11th Circuit thinks it’s fine for Alabama to jail (up to one year for first violation) or fine (up to $50,000) anyone who gets caught selling as much as a dildo. (PDF of the statue is here.)

I’m rather pessimistic about the outcome of such a case, given the recent hostile take over of the SCotUS by the religious right.  As is noted in the comments at Skepchick, the court may rule in a surreal Ron Paul Bizarro-land way that this is a States’ Rights issue, to mask their real, religious motivation.

Announcements And General HouseKeeping

If you’ve been paying close attention, you may have noticed a few changes ’round here.

Our time’s been a bit limited due to family stuff, and what time we’ve had available to spend blogging we’ve used in some behind-the-scenes stuff.

First, The Boy‘s been helping a personal friend set up her very first blog.

She’s still working on the aesthetics and getting set up for her comfort, but she’s started out with a pretty good best-friend-rant involving a 3000 mile road trip and hot motel sex. (OK, I’m lying about the motel sex just to trick you into going over, but do it anyway.) Please welcome Diana at Themyscira to the blogosphere.

In other blogroll news, because I said so again, why?, Berlzebub’s Inferno, Eat My Fucking Stilettos, Grace Under Fire, Martyne’s Place, Persistent Thursday, and Vrai’s House of Interminable Horror are all recent additions to our MonkeySphere. Check them out, because they wouldn’t be there if they sucked.

Further down that same sidebar, you’ll note we’ve added RSS feeds for The World’s Greatest Astronomer, Dr. Phil Plait (IT’S PRONOUNCED TO RHYME WITH SKATE, IT’S NOT THAT FRAKKIN’ HARD!) over at BadAstronomy, and also for Sports Illustrated’s most improved NHL team, the Boys in Black and Orange, the Philadelphia Flyers. I love hockey, and if you don’t, you suck. Just so y’know.

Moving on, I tweaked a few little things in the right side bar, and added the Creative Commons license. I’m trying to force myself to remember that just because it’s on the web and I like it does not mean it’s mine. I have occasionally maybe perhaps been somewhat loose with my own definition of “fair use”, and I’m trying to get on the wagon. I wouldn’t want my stuff ripped off, so I’m going to try to work with CC images for illustrating my posts, and do the best I can to remember to credit and link. You may have noticed that I’ve been trying to do that lately. You should too.

Flyers Will Score A Huge Rebound This Year

Philadelphia FlyersOh, the laughing stock of the NHL will so be the scourge of Hockey this year. Fear and dread of Philadelphia, respect for the city of brotherly shove, it’ll be back in a big way this season, you can bet on that. We’re heading in the right direction now.

I’m throwing away the paper bag already.

Somebody Warm Up Mike Nifong’s Handcuffs

I wouldn’t want the cold steel to make him uncomfortable…

On the AP wire:

DURHAM, N.C. (AP) — Attorneys for three Duke lacrosse players who were falsely accused of rape asked a judge Friday to hold the prosecutor in the case in criminal contempt of court.

Mike Nifong “personally engaged in a pattern of official prosecutorial misconduct, which violated at least a dozen laws, rules and court orders designed to protect due process and the pursuit of truth,” the attorneys wrote in their request.

They wrote that the scope of Nifong’s misconduct “shocks the conscience and defies any notion of accident or negligence.”

A disciplinary committee of the North Carolina State Bar disbarred Nifong on June 16. He has submitted his resignation as Durham County’s district attorney.

If Superior Court Judge W. Osmond Smith III finds Nifong in contempt he could be jailed up to 30 days and fined up to $500.

 

Not nearly severe enough for all the damage he caused, but it’s a start.

Bye Bye Law License – Mike Nifong Disbarred

RALEIGH, North Carolina (CNN) — The prosecutor in the Duke University lacrosse team rape case was disbarred Saturday for unethical conduct, and the chairman of the disciplinary committee blamed “political ambition” for his downfall.

Earlier Saturday, the panel of the North Carolina State Bar concluded that Durham County, North Carolina, District Attorney Mike Nifong violated more than a dozen ethics rules in prosecuting the case against the now-exonerated players.

“This matter has been a fiasco,” said disciplinary committee chairman F. Lane Williamson. “It seems that at the root of it is self-deception arising out of self-interest.

“We had a prosecutor who was faced with a very unusual situation in which the confluence of his self-interest collided with a very volatile mix of race, sex and class.”

“We are in unanimous agreement there is no discipline short of disbarment that would be appropriate in this case, given the magnitude of the offenses we have found and the effect upon the profession and the public,” Williamson said.

Williamson said that racially inflammatory remarks Nifong made last year “were to further his political ambition.” The three athletes are white, and their accuser is black.

And certainly appropriate:

One of those testifying Saturday was Evans’ father, David Charles Evans, who said the ordeal caused extreme stress to him and his family.

Evans said his son “believes that when he dies, no matter what he does in his life, he will be [remembered as] one of the three Duke players accused of rape.”

State Bar prosecutor Douglas Brocker told the committee that “Mr. Nifong did not act as a minister of justice, but as a minister of injustice,” AP reported.

After the hearing, attorneys for the exonerated lacrosse players said they would push for criminal charges against Nifong.

“I don’t think that any of us are done with Mr. Nifong yet,” said Jim Cooney, Seligmann’s attorney.

Nifong Found Guilty – Contends For 2006 Ass of the Year

Mike Nifong was found guilty of pretty much everything of which he was accused by the bar.

He characterized some of his statements like when he called the Duke lacrosse players “a bunch of lacrosse players from Duke raping a black girl” as maybe getting “carried away a little bit”.

RALEIGH, North Carolina (AP) — Mike Nifong broke several rules of professional conduct during his disastrous prosecution of three Duke University lacrosse players falsely accused of rape, committing “deceit and misrepresentations,” a disciplinary committee ruled Saturday.

The committee must now decide if the longtime prosecutor in Durham County, who has already pledged to resign his post as district attorney, should be stripped of his law license.

The North Carolina State Bar charged Nifong with breaking several rules of professional conduct, including lying to both the court and bar investigators and withholding critical DNA test results from the players’ defense attorneys.

The committee, after deliberating for a little more than an hour, unanimously agreed with the bar on almost every charge — including the most serious allegations — that Nifong’s actions involved “dishonesty, fraud, deceit and misrepresentation.”

“Mr. Nifong did not act as a minister of justice, but as a minister of injustice,” state bar prosecutor Douglas Brocker said Saturday morning in his closing statement.

Brocker told the disciplinary hearing committee that as Nifong investigated allegations that a stripper was raped at a March 2006 party thrown by Duke’s lacrosse team, he charged “forward toward condemnation and injustice,” weaving a “web of deception that has continued up through this hearing.”

The bar charged Nifong, a prosecutor in Durham County for his entire three-decade legal career, with breaking several rules of professional conduct, including lying to both the court and bar investigators and withholding critical DNA test results from the players’ defense attorneys.

Nifong acknowledged Friday he was likely to be punished by the disciplinary committee for maybe getting “carried away a little bit” when talking publicly about the case. He said he regretted some of his statements, including a confident proclamation that he wouldn’t allow Durham to become known for “a bunch of lacrosse players from Duke raping a black girl.”

Dame Wiggly Butt has a very equitable idea for his sentencing.

I like it.
